Article 252 Where the loss of or damage to the su, bject matter insured within the insurance converage is caused by a third person, the right of the insured to demand compensation from the third person shall be subrogated to the insurer from the time the indemnity is paid.

第二百五十二条保险标的发生保险责任范围内的损失是由第三人造成的，被保险人向第三人要求赔偿的权利，自保险人支付赔偿之日起，相应转移给保险人。

E A liability insurer, who by payment has discharged in full or in part the liability of a tortfeasor and has thereby discharged in full its obligation as insurer, is subrogated to the tortfeasor,s right of contribution to the extent of the amount it has paid in excess of the tortfeasor,s pro rata share of the common liability.

本保险扩展赔偿被保险人根据货运合同中&互有责任碰撞&条款的比例责任有关可获赔偿的损失。在船东根据该条款提出任何索赔的情况下，被保险人同意通知保险人，保险人有权自负费用，为被保险人对此种索赔抗辩。
