Through the autocriticism of our legislation and the lucubrating of the advanced legislation of the developed country, this article rise the precautionary principle, control principle, intervention principle, in principle, and responsibility principle as the basic principles of our biosafety legislation. Then improve our biosafety legislation system under the guidance of these principles.

首先，应当制定一部《生物安全法》作为框架性的生物安全管理法律；其次，制定各领域的生物安全专项管理法律，或对原有的有关法律进行补充；再次，提出制定转基因生物环境影响和安全评价、生物技术成果越境转移管理、转基因生物标签管理等方面的法律、法规，应对目前生物安全的主要问题，并对生物技术损害法律责任的承担和纠纷处理程序立法提出建议；最后，指出其他部门立法中有关生物安全方面应当进行的修改，包括知识产权法中的基因专利方面，民法中有关基因隐私权方面，刑法中的基因犯罪方面，等等。

Part two is about the analysis of theoretical basis for the social assistance legal institutions,which includes their department classification,their analysis of basic concept,their theoretical support and their analysis of value,and so on.The author holds that they regulate the redistributive economic relations requiring state intervenes appropriately and reflected by the actions of social assistance,they reflect and determine the implication and distribution of the redistributive economic relations,meanwhile they reflect and determine the distribution and direction of the benefits of social assistance intervened by state appropriately.Their appearance expresses the legal connection created for the poverty phenomena between state and the poor,so these legal institutions should be classified into the department of social distributive law in economic law which reflect the essence of economic law that state intervenes the economic relations required intervention appropriately.

第二部分是社会救助法律制度的理论基础分析，其中包括社会救助法律制度部门归属辨、社会救助法律制度的基本理念剖析、社会救助法律制度的理论支持以及社会救助法律制度的价值分析等内容，认为社会救助法律制度规制了由社会救助行为所反映出来的这种需要国家适度干预的再分配经济关系，反映并决定了这种再分配经济关系的牵连和分布，同时反映和决定了在国家适度干预下相关社会救助利益的分配和流向，其出现媒介了国家和贫困者之间因为贫困现象而生成的法律关系，这一法律制度归属于经济法部门中的社会分配法律制度子部门，明显地体现着经济法的本质属性——国家对需要干预的经济关系的适度干预。

While combining these documents with administrative regulations and other informal sources, we find that the boundary of power of the State Environmental Protection Administration of China is very definite. But the boundary of other environmental protection administrations is unclear.

就中央法律文件对建设项目环境影响评价文件审批权的配置而言，宪法、组织法和环境保护领域法律的规定是比较抽象而不明确的，但当结合行政法规、规章以及其他规范性文件进行考察时，就会发现，中央法律文件对于国家环境保护行政主管部门审批权力的配置并不是不清楚，而是十分明确的；但对各级地方环境保护行政主管部门的权力配置则主要是授权性的规定。

However, today in the legal service industry, there are some conditions that can not be ignored: various subjects supervised by different public sectors,with different entry requirements and professional conduct ,at different cost,provide with the same or similar services in a market .That lead to the disorderly competition, lack and dislocation of the government supervision ,the uneven distribution of legal services resources and the growing tendency of commercial issues and uncredibility on the legel service market. That seriously influnce the healthy development of the legal service market,affect the values of the legal services fuctions and fulfill pushing on the rule of law,improvement of the socialist market economic system and building a socialist harmonious society with great efforts.

但是，法律服务业发展到今天，出现了一些不容忽视的状况：多个法律服务主体以不同的准入条件、不同的执业规范、不同的服务成本在同一个市场上提供相同或相似的服务，受到不同部门的监管，导致多个主体无序竞争、政府监管缺位错位情况突出、法律服务主体资源地区分布不平衡、法律服务业诚信缺失、商业化倾向日趋严重等问题，严重影响了法律服务市场的健康发展，难以有效实现法律服务的价值功能，难以适应依法治国、完善社会主义市场经济体制和构建社会主义和谐社会的需要。
