The suggestions go as follows: making a competing subject with food practice discipline and healthy running mechanism; quickening our modern enterprise system reform and making a better market economy system; normalizing government's conduct and letting the market play the leading role; on the basis of fair competition, going on enterprise merging and promoting the rationalization of the accounting market; setting up an effective supervizing system with laws and trade discipline.

本文在分析会计市场不正当竞争的现状及原因的基础上，着重论述了制止不正当竞争、推动会计市场秩序化的建议与措施：努力塑造执业行为规范、运行机制健全的竞争主体；加快现代企业制度改革，完善公平竞争的市场经济机制；切实规范政府行为，摆正政府与市场的关系；继续鼓励基于公平竞争之上的合并和重组，促进会计市场结构合理化；尽快建立国家法律和行业自律相结合的会计市场监管体系。

In terms ofdiversification,this dissertation believes that for the assuming ways of the criminal responsibilitieson the securities crimes,such penalties as death penalty,life imprisonment,deprivation of politicalrights,confiscation of property,and public surveillance shouldn't be applicable,such penalties asfixed-term imprisonment,criminal detention and fine should be applicable,and such penalties asprohibition of special professions and disincorporate should be added,and such assuming ways ofnon-penalties should be applicable as being reprimanded,being ordered to make a statement ofrepentance,to offer an apology or to pay compensation for the losses,being subjected toadministrative penalty or administrative sanctions by the competent department,and simpledeclaration of being guilty.

在承担方式的多样化方面，认为证券犯罪不应当适用死刑、无期徒刑、剥夺政治权利、没收财产、管制等刑罚方法，可以适用有期徒刑、拘役和罚金，同时应该增补禁止从业和解散法人两种刑罚方法，并且适用训诫、责令具结悔过、赔礼道歉、赔偿损失、进行行政处罚或者行政处分或者单纯宣告有罪等非刑罚方法；在承担方式的合理化方面，认为应当重点进行三个方面的工作：一是提高罚金刑的地位，二是资格刑的并科，三是加强对单位证券犯罪的处罚，并指出了具体进行的措施和途径。

基于上述分析，我提出了完善中国刑法中法定刑幅度配置方式的合理化建议：一是认识论上的改变，即确立刑事立法上的消极国家观；二是方法论上的更新，包括典型立法方法的运用和量刑档次即罪种法定刑幅度的具体化和确定化两方面。

It tries to find the special ethos of Chinese nationality as in opposition to western cultural universalism. However, the overall interpretation of China by historicism is ambiguous. Of western civilization, Chinese historicism rejects its value of Enlightenment but accepts its dangerous idea of statism. It can be predicted that the alternative modernity Chinese historicism is pursuing will end up being a de-valued and de-ethicized state power with its system legitimized in the Weberian fashion.
