Whether due or not due, absolute or contingent, liquidated or unliquidated, determined or undetermined, whether Seller may be liable individually or jointly with others, whether recovery upon such indebtedness may be or hereafter becomes barred by any statute of limitations or whether such indebtedness may be or hereafter becomes otherwise unenforceable, and includes Sellers prompt, full and faithful performance, observance and discharge of each and every term, condition, agreement, representation, warranty undertaking and provision to be performed by Seller under these Agreements.

In the event that the goods are found to be in breach of the said warranty and so notified during the term of the warranty in accordance with Clause 18.1 and the cause of such breach is attributable to Seller, Buyer has the right to lodge claims against Seller.

13.4如果买方发现卖方交付的货物不符合本合同规定及上述保证，且依照本合同第18.1条在保证期内通知卖方，而且违反保证的原因在于卖方，那么买方有权向卖方提出索赔，本担保项下的买方权利和卖方义务按第18条约定处理。

B. Within the Warranty period stipulated in Clause 16 hereof, should the quality and/or specification of the contract goods be found not in conformity with the contracted stipulations, or should the contract goods prove defects for any reasons attributive to the seller, including latent defect or the use of unsuitable materials, the buyer shall have the right to claim against the seller on the strength of the inspection certificate issued by the bureau.

在本合同第16条规定的保证期内，如发现合同货物的质量及/或规格与本合同规定不符或发现合同货物无论任何由于卖方的原因引起的缺陷或使用不良的原料，买方有权凭检验检疫局出具之检验证书向卖方索赔。
