第二十八条违反本办法第二十四条第一款规定，在生态公益林区域内进行采种、采脂等经营活动，致使森林、林木受到毁坏的，依照《中华人民共和国森林法》第四十四条的规定，赔偿损失；由县级以上人民政府林业主管部门责令停止违法行为，补种毁坏株数1倍以上3倍以下的树木，可处毁坏林木价值1倍以上5倍以下的罚款；拒不补种树木或者补种不符合国家有关规定的，由林业主管部门代为补种，所需费用由违法者支付。
