索赔

During the contract period, when the Second Party encountered an injured, crippled or death accident on business, the employer would help the Second Party to claim for compensation to insurance agent.

到达阿联酋后甲方为乙方办理其工伤保险，（保险名称及额度以公司统一规定为准），因此如果乙方在执行合同期间发生意外工伤及伤亡事故，则甲方负责为乙方办理保险索赔，索赔款项扣除事故处理费用后由甲方全额转交乙方或乙方家属，乙方及家属不得再提出任何额外附加条件。

This insurance is extended to indemnify the Assured against such proportion of liability under the contract of affreightment "Both to Blame Collision" Clause as is in respect of a loss recoverable hereunder In the event of any claim by shipowners under the said Clause the Assured agree to notify the Underwriters who shall have the right, at their own cost and expense, to defend the Assured against such claim

本保险扩展赔偿被保险人根据货运合同中&互有责任碰撞&条款的比例责任有关可获赔偿的损失。在船东根据该条款提出任何索赔的情况下，被保险人同意通知保险人，保险人有权自负费用，为被保险人对此种索赔抗辩。

本保险扩展赔偿被保险人根据水上货运合同中&互有责任碰撞&条款，如下文所示可补偿的损失的比例责任部分。倘若船东根据该条款提出任何索赔，被保险人同意通知保险人，保险人有权自负费用对此种索赔为被保险人进行抗辩。

Should the Vessel be a constructive total loss but the claim on the insurance on hull and machinery be settled as a claim for partial loss,, no payment shall be due under this Clause 9

若保险船舶构成推定全损，但根据船体和机器保险的索赔是按照部分损失解决索赔者，保险人根据本第9条不负赔偿责任。

If the vessel comes into collision with another ship as a result of the negligence of the other ship and any act, neglect or default of the Master, Mariner, Pilot or the servants of the carrier in the navigation or management of the vessel, the owners of the cargo carried hereunder will indemnify the carrier against all loss or liability to the other or non-carrying ship or her owners in so far as such loss or liability represents loss of, or damage to, or any claim whatsoever of the owners of said cargo, paid or payable by the other or non-carrying ship or her owners as part of their claim against the carrying vessel or carrier.

如船舶由于他船疏忽以及本船船长、船员、引航员或承运人的受雇人员在驾驶和管理船舶中的行为、疏忽或不履行职责而与他船碰撞，则根据本提单承运的货物的所有人应补偿承运人的一切损失或对他船亦即非载货船舶或其所有人的赔偿责任，但此种补偿应以上述损失或赔偿责任所体现的已由或应由他船亦即非载货船舶或其所有人付给上述货物所有人其货物的灭失或损坏或其提出的任何索赔的数额为限，且这种损失或赔偿责任已由他船亦即非载货船舶作为其向载货船舶或承运人提出的索赔的一部分，将其冲销、扣除或追回。

If the vessel comes into collision with another vessel as a result of the negligence of the other vessel and any act, negligence or default of the Master, Mariner, Pilot or the servants of the Carrier in the navigation or in the management of the vessel, the Merchant will indemnify the Carrier against all loss or liability to the other or non-carrying vessel or her Owner in so far as such loss or liability represents loss of or damage to or any claim whatsoever of the owner of the said goods paid or payable by the other or non-carrying-vessel or her owner to the owner of said cargo and set-off, or recouped or recovered by the other or non-carrying vessel or her Owner as part of his claim against the carrying vessel or Carrier.
